1. Introduction
1.1 These Terms and Conditions govern the sale of wines through the APICIVS online store, operated by DPWEA – Agência de Exportação de Vinhos do Douro e do Porto, Lda., VAT no. PT510616992, with registered office at Avenida Rainha Santa Isabel, Lote 10-B, Loja 7, 5000-434 Vila Real, Portugal, registered with the Commercial Registry of Vila Real under the same number (510616992), hereinafter referred to as “APICIVS”.
2. Legal Restrictions and Minimum Age
2.1 The purchase of alcoholic beverages is reserved for individuals of legal drinking age. By placing an order, the buyer confirms that they are at least 18 years old or of legal drinking age in their country of residence. APICIVS may request proof of age upon delivery.
2.2 It is the buyer’s responsibility to ensure that the purchase and import of alcoholic beverages are permitted under the laws of the destination country. Orders placed from, or intended for delivery to, countries where alcohol consumption is prohibited will be refused or cancelled.
3. Products and Availability
3.1 APICIVS sells rare and exclusive Port wines, including Single Harvest (Colheita) Ports and numbered editions. Due to their nature, these products are offered in limited quantities and cannot be replaced.
3.2 Product images and descriptions are for illustrative purposes only. Labels and packaging may vary slightly.
3.3 All orders are subject to stock availability.
4. Prices, Taxes and Duties
4.1 Prices shown include Portuguese VAT at the applicable legal rate (currently 23%) and the Excise Duty on Alcohol and Alcoholic Beverages (IABA) in accordance with the Portuguese Excise Duty Code (CIEC). For deliveries to other EU countries, the VAT rate of the destination country may apply, replacing Portuguese VAT and not being cumulative, in accordance with applicable legislation.
4.2 For deliveries outside Portugal, additional customs duties, import taxes, local VAT or other similar charges may apply in the destination country. These costs are the buyer’s responsibility and are not included in the final price displayed at checkout.
4.3 APICIVS shall not be held responsible for delays, holds, additional charges, refusals or any other actions arising from customs procedures, including clearance or decisions by local authorities regarding the import or acceptance of alcoholic beverages.
4.4 If the buyer refuses or fails to pay the applicable duties or taxes, resulting in the return of the goods, APICIVS is under no obligation to issue any refund.
5. Orders and Payments
5.1 Orders may only be placed through the website and are confirmed upon receipt of full payment.
5.2 Accepted payment methods include credit/debit card, MB WAY (for Portugal) and other secure electronic payment options displayed at checkout.
5.3 All transactions are processed via encrypted and secure platforms.
5.4 APICIVS reserves the right to refuse or cancel any order in the event of suspected fraud, incorrect information or breach of these Terms.
6. Shipping and Delivery
6.1 Deliveries are handled by our logistics partners (currently Mail Boxes Etc.) and may be carried out by a local partner in the destination country.
6.2 Shipping costs are calculated at checkout and vary depending on destination and parcel weight.
6.3 Estimated delivery times depend on destination and commence only after payment confirmation.
6.4 All shipments include insurance against loss or breakage up to the invoiced value of the goods (excluding shipping costs):
– The buyer must inspect the goods upon delivery and record any visible damage on the carrier’s delivery note.
– Claims for damage must be submitted within 5 working days of delivery and accompanied by photographic evidence of the goods and original packaging.
– The buyer is responsible for promptly notifying APICIVS so that the insurance can be activated.
– The buyer must provide any information or documentation required for the filing and settlement of the claim under the insurance policy.
– The insurance covers only verified loss or breakage occurring during transit.
– The insurance does not cover delays or losses resulting from customs inspections, seizures or failure of customs clearance by local authorities.
6.5 For deliveries within the European Union: the risk of loss passes to the buyer upon delivery. For deliveries outside the EU: the risk of loss passes to the buyer upon shipment; however, APICIVS provides, for the buyer’s benefit, insurance coverage for the goods during transit to cover verified loss or breakage while under the carrier’s responsibility. The buyer must cooperate and provide any information or documentation required for the filing and settlement of the claim under the insurance policy. This insurance does not cover delays or losses resulting from customs inspections, seizures or failure of customs clearance by local authorities.
7. Right of Withdrawal and Returns
7.1 In accordance with EU law, consumers have the right to withdraw from the contract within 14 days from delivery, provided the product is returned sealed, unopened and in perfect condition.
7.2 Given the unique and limited nature of our wines, returns from outside the EU or of opened/unsealed products are not accepted, except where the error is attributable to APICIVS.
7.3 Return shipping costs are borne by the customer, unless the return results from an error on our part.
8. Limitation of Liability
8.1 APICIVS shall not be liable for indirect or consequential damages, including loss of enjoyment, delay or damage caused by third parties.
8.2 Liability is limited to the value of the goods purchased, except in cases of fraud or gross negligence.
9. Dispute Resolution
9.1 Under Portuguese Law No. 144/2015, consumers may refer disputes to the competent Alternative Dispute Resolution (ADR) entity. More information is available at www.consumidor.pt.
9.2 These Terms are governed by Portuguese law. Any dispute shall be submitted to the exclusive jurisdiction of the courts of Vila Real, Portugal.
10. Data Protection
10.1 Personal data provided during the ordering process are collected and processed in compliance with the General Data Protection Regulation (GDPR). Data will not be shared with third parties except where necessary to process the order. Please refer to our Privacy Policy for more details.
11. Intellectual Property
11.1 All content on this website, including text, logos, images, designs and product descriptions, is the intellectual property of APICIVS and may not be reproduced without prior written authorisation.
